Artificial Intelligence (AI) Usage 

Morgenstern Publishing is the handmade creation of Morgana Meredith Morgenstern and is dedicated to preserving human artistry. We affirm that AI is never used in isolation; it is only incorporated selectively alongside authentic human creativity.

Mature Content Warning

Music marked with the Mature Content Warning label may include strong language, suggestive themes, references to violence, or emotionally intense material. These works are intended for thoughtful engagement and creative exploration. Listener discretion is advised.

Offensive Content Warning

Certain content, including music, may be labeled with an Offensive Content Warning.

This designation reflects material that is presented from a character’s perspective within the world of M.M. Morgenstern’s novels.

Such content may contain:

• Strong language
• Violent or derogatory references
• Sexual themes
• Other mature elements

These depictions are not intended as real-world statements from Morgenstern Publishing or its authors, either politically or artistically.

Coincidental Similarities

Morgenstern Publishing creates original works of fiction inspired by real-world issues to explore and critique cultural and systemic problems. All characters, organizations, and events depicted in our stories are fictional. Any resemblance to actual persons, living or dead, or to real events is purely coincidental. Our works are intended for artistic and educational purposes and should not be interpreted as factual accounts or endorsements of any real individuals or entities.

Protection of Digital Likenesses & Intellectual Property

All character likenesses, including but not limited to 3D model-based and AI-generated designs, are protected under applicable copyright, trademark, and publicity rights laws in the State of Texas and under U.S. federal law. This protection extends to all websites, digital platforms, products, and services operated by or affiliated with Morgenstern Publishing, LLC.

Intellectual Property Protection 

All content, including visual assets, character designs, branding elements, and proprietary digital creations, is safeguarded under Texas intellectual property statutes, including the Texas Uniform Trade Secrets Act, Texas Copyright Statute, and relevant federal protections such as the Digital Millennium Copyright Act (DMCA). Unauthorized reproduction, distribution, or commercial use without explicit prior licensing is strictly prohibited and may result in legal action.

Licensing Requirement

Any third-party use of these likenesses, assets, or intellectual property must be licensed in advance without exception. Licensing inquiries should be directed to contact@morgensternpublishing.com.

Unsolicited Manuscript and Materials Policy

Morgenstern Publishing does not accept unsolicited manuscripts, proposals, story ideas, artwork, characters, scripts, worldbuilding materials, or other creative content. Any materials submitted without prior written authorization will be deleted, discarded, or destroyed without review and without acknowledgment.

By submitting unsolicited material, you acknowledge and agree that:

• No confidential, fiduciary, agency, contractual, publishing, or other relationship is created between you and Morgenstern Publishing;
• Morgenstern Publishing assumes no duty or obligation regarding the submission;
• Morgenstern Publishing may already be developing or may later develop, publish, acquire, license, or distribute works that are similar to the submitted material; and
• You waive any claim arising from any alleged similarity between your submission and any work created, acquired, published, or distributed by Morgenstern Publishing.

Unsolicited creative submissions are not accepted under any circumstances.

Takedown & Enforcement Policy 

We actively enforce our intellectual property rights across all platforms and products. If unauthorized use is detected, we will issue a formal cease-and-desist notice and pursue DMCA takedown requests where applicable. Continued infringement may result in legal action, financial penalties, and claims for damages.

Fair Use Acknowledgment 

Morgenstern Publishing supports fair use under U.S. copyright law, including commentary, criticism, education, and discussion. Respectful, transformative content — such as thoughtful reviews, analyses, and creator discussions, including in certain monetized formats — may qualify as fair use when limited in scope and clearly distinct from the original work. Uses that are commercial in nature, exploit substantial portions, or misrepresent affiliation with Morgenstern Publishing do not qualify and may be subject to enforcement.

Publishing Disclaimer

Morgenstern Publishing operates independently from Torii House Phonograph Co., though both entities are owned and managed by Morgana Morgenstern.
